Kit Revolution Ltd – Terms and Conditions

Welcome to Kit Revolution Ltd ("Kit Revolution", "we", "us", "our").
These Terms and Conditions ("Terms") govern your use of the Kit Revolution platform,

including our website, features, and services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree, you must not use the Service.
We may update these Terms from time to time. Where changes are material, we will provide notice via the Service or email.

Your continued use after changes take effect constitutes acceptance of the revised Terms.

You must be at least 18 years old to create an account or sell items on the Service.
Parents or legal guardians may create and operate an account on behalf of a minor, and remain fully responsible for all activity carried out under that account.
We may suspend or terminate accounts if we reasonably believe eligibility requirements have not been met.

Each individual may only hold one account.
We reserve the right to suspend or terminate accounts in cases of fraud, misrepresentation, or breach of these Terms.
Accounts are non-transferable and must be registered in your own name.
You are responsible for maintaining the confidentiality of your login credentials and all activity on your account.

You agree not to:

(a) list prohibited items (including counterfeit goods, unsafe equipment, illegal or pornographic items);
(b) misrepresent items;
(c) complete transactions off the platform;
(d) manipulate prices or interfere with listings;
(e) send spam or collect user information without consent.

We may remove listings or suspend accounts for breaches of these rules.

Kit Revolution acts as a commercial agent for sellers.
When a buyer pays Kit Revolution (via Stripe or another payment processor), this constitutes valid payment to the seller.
Payments are in GBP.

There are no fees to list items and sellers are not charged any fees.
Buyers pay a Buyer Protection Fee (disclosed at checkout) and delivery costs.
Cash or offline transactions are strictly prohibited.

Sellers must dispatch sold items promptly using an approved carrier (currently Evri, unless otherwise stated).
Once an item is handed to the carrier, risk of loss or damage passes to the buyer.

Kit Revolution is not the carrier and does not provide delivery services. Deliveries are subject to the courier’s own terms and conditions

Sellers are responsible for packaging items securely. Kit Revolution is not liable for any loss, delay, or damage occurring in transit.

Unless otherwise stated, items are second-hand and sold as described, without a general right of return.

If an item is faulty, not as described, or prohibited, buyers must raise a dispute within 2 days of delivery.

If no dispute is raised within this timeframe, funds will be released to the seller.
Kit Revolution may mediate disputes but final responsibility lies with the seller.
Nothing in these Terms affects statutory consumer rights under UK law.

By submitting listings, images, or other content ("Content"), you grant Kit Revolution a limited, non-exclusive, royalty-free licence to use, display, reproduce, and promote such Content for the purposes of operating and marketing the Service.
You retain ownership of your intellectual property rights.
You must not upload unlawful, infringing, or offensive content.

We process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to such processing.
We comply with UK GDPR and the Data Protection Act 2018.

The Service is provided "as is" and without warranties of any kind.
To the maximum extent permitted by law, Kit Revolution shall not be liable for indirect, incidental, or consequential damages, loss of profits, or loss of data.
Our total liability in any 6-month period shall not exceed the greater of £100 or the total fees paid by you to Kit Revolution in that period.

You agree to indemnify and hold harmless Kit Revolution, its officers, employees, and agents from claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Service.

We may suspend or terminate your account at any time if you breach these Terms, engage in fraud, or misuse the Service.
You may close your account at any time.
Certain obligations (including indemnity and limitation of liability) will survive termination.

These Terms are governed by the laws of England and Wales.
You agree to submit to the exclusive jurisdiction of the English courts.

If any part of these Terms is found invalid, the remaining provisions shall remain in full force.
Our failure to enforce any right does not constitute a waiver.
We may assign our rights and obligations under these Terms without restriction.
